TERMS
AND CONDITIONS OF SALE
SandPiper reserves
the right to amend these Terms & Conditions of Sale without prior notice.
1. Definitions
All tickets are sold
by SandPiper (Sandpiper Digital Payments Asia Pte Ltd) (ÒSandPiperÓ)
as agent for and on behalf of the ÒVenue
OwnerÓ responsible for the venue in which the
event will be held ÒVenueÓ and/or the ÒPromoterÓ responsible for the event for which they are sold (ÒEventÓ).
ÒTicket
HolderÓ or ÒYouÓ refers to the person or legal
entity identified in the Order as the purchaser of Products or the person
intending to use the ticket for entry.
ÒBuyerÓ refers to the
person who is intending to purchase Products offered on SandPiper.asia.
ÒCardÓ refers one of the following credit cards: VISA, MasterCard,
and AMEX.
ÒCard
CompanyÓ means the applicable payment and Card
processing entity for the relevant Card.
ÒConditionsÓ means these Terms & Conditions, and shall include where
applicable, the Privacy Policy and other conditions and policies found on SandPiper.asia.
ÒEventÓ means show, screening, performance, event, exhibition,
conference, service, attraction, ride, or other product or service sold by SandPiper.
ÒForce
Majeure of EventÓ means any event or circumstance the
occurrence and the effect of which SandPiper could not reasonably prevent or
avoid including:
(i) explosion, fire,
flood, war, earthquake, storm or other natural disasters;
(ii) war, declared or
undeclared, sabotage, insurrection, terrorist or criminal acts, riot or civil
disturbance;
(iii) import or
export regulations or embargo or requisition restrictions regulations bye-laws
prohibition or any acts or measures or any intervention of any governmental or
regulatory authority;
(iv) epidemic,
quarantine restrictions, outbreak of disease or any travel restrictions or bans
(including bans on non-essential travel) issued by the World Health
Organisation or any governmental authority;
(v) strike, lock-out,
work stoppage or other industrial action or trade dispute (whether involving
employees of SandPiper or any other person); and
(vi) any default act
or omission on the part of SandPiperÕs
suppliers or sub-contractors.
ÒOrderÓ means an online order, placed at the Site by a Ticket
Holder with SandPiper, for Products in accordance with these Conditions.
ÒPartiesÓ means SandPiper and the Buyer and ÒPartyÓ means any one of them.
ÒProductsÓ means products and/or services for which SandPiper invites
orders on this Site, including Tickets.
ÒOrganiserÓ or ÒPromoterÓ means the person or entity operating,
managing, producing, organising, promoting or providing the Event for which
Tickets are being ordered.
ÒThird
Party ProductsÓ means products and services of third
parties advertised on or available at the Site or websites linked from the
Site, including Products supplied by third parties, Events which are not
organised by SandPiper regardless of whether SandPiper is selling Tickets for
such Events, and tickets sold by third parties.
ÒTicketsÓ means tickets in any form or medium designated by SandPiper,
for admission to Events, for which SandPiper invites orders on this Site.
ÒTicket
HoldersÓ means all persons for whom Buyer is
purchasing Tickets or who will be holding Tickets purchased by Buyer.
ÒVenueÓ means the venue, location, vehicle or craft hosting the
Event.
ÒVenue
OwnerÓ means the operator, manager or owner
of the Venue.
2. General
All orders for
tickets are subject to availability and acceptance and confirmation by SandPiper.
SandPiper reserves the right to accept or reject any such order, and shall not
be required to provide any reason for rejecting any order. Subject to the terms
and conditions set out below, you will receive your tickets only after SandPiper
has accepted and confirmed your order.
Ticket is only valid
when purchase through an authorised agent.
The ticket is not to
be tampered, altered or defaced, otherwise considered void and invalid.
The ticket holder
voluntarily assume all risks and dangers incidental to the event whether
occurring prior to, during or subsequent to the actual event, including any
death, personal injury, loss, damage or liability.
The ticket holder
shall abide to the full terms & conditions found on SandPiper.asia, all
entry conditions at the Venue and all terms & conditions as stated by the
Organiser.
By ordering the SandPiper
tickets:
(a) you warrant and
confirm that you are at least 18 years old, or (if you are younger than 18
years old) that you have obtained the consent of your parent or legal guardian
to purchase any SandPiper tickets and that your parent or legal guardian has
agreed to be responsible for ensuring that you will abide and be bound by the
terms and conditions set out below; and
(b) you agree, on
your own behalf and as agent for any person for whom you are ordering such
tickets (each such person, a ÒTicket HolderÓ and/ or ÒTicket BuyerÓ) to abide
and be bound by the Conditions set out below.
3.
Purchase & Payments
Ticket Buyers are
required to sign up for an account with SandPiper in order to make purchases
for products offered on the site.
Unless otherwise
agreed by SandPiper in writing, payment for the Products shall be made by the
Buyer in full by BuyerÕs valid Card before collection (if
applicable)or delivery of Products.
The Buyer shall bear
all shipping, delivery, handling and other charges (where applicable), as well
as all applicable taxes (including but not limited to Goods and Services Tax)
at the prevailing rates.
All Card payments are
subject to the approval of the Card Company and the relevant paying bank. SandPiper
shall not be liable in any way if the Card Company or the paying bank refuses
to process or accept any Card or Card particulars for any reason.
The Ticket Buyer
agrees to submit to SandPiper and its payment service provider such Card
information and other personal and delivery information as may be reasonably
requested by SandPiper or its payment service provider to process the Order,
payment for the Order, and to arrange for delivery and invoicing. All
information submitted shall be subject to SandPiperÕs Privacy Policy.
4. Collection
SandPiper operations
on an online system. With every successful acceptance, payment and confirmation
of order by SandPiper, Ticket Buyer will be issued a booking and the e-ticket
via the provided email. The e-ticket will serve as Òthe ticketÓ to be presented
upon entry to the Venue or Event.
5. Admission
Ticket holder must
have a valid ticket to be presented for entry. Ticket holder with invalid
ticket shall be refused entry.
As per Venue or
Organiser entry conditions, the ticket holder may be required to produce his/
her personal identification or documentation for tickets limited to a
restricted audience or concessionary group, and/ or submit to a search for any
prohibited items not limiting to weapons, drugs. Prohibited items will be
confiscated and destroyed.
Ticket holder shall
observe all age, height and other entry restrictions at the Venue and/ or in
publicity materials and no refunds will be made for ignorance of restrictions.
The Venue/ Organiser
reserves the right to deny entry or evict the ticket holder whose conduct is
disorderly or inappropriate. Latecomers may be admitted at the discretion of
the Organiser/ Venue.
Ticket must be
retained through the event, unless otherwise stated or instructed by Organiser/
Venue.
6. Force
Majeure of Event
SandPiper shall not
be liable for or be deemed to be in breach of these Conditions by reason of any
failure in performing any of its obligations under these Conditions during any
period in which performance is delayed by any Force Majeure Event.
SandPiper shall
notify the Buyer of any delay or failure arising through any Force Majeure
Event and provide a revised collection (if applicable)/delivery date as soon as
practicable. The Buyer shall not seek for a refund, exchange or claim by reason
of any such delay or failure.
7. Changes
& Cancellations, Refunds & Exchanges
Tickets sold are
non-exchangeable and may not be resold, or redistributed, or remarketed without
prior consent of the Organiser.
Booking and handling
fees are not refundable.
Any cancellation, changes
& refunds shall be directed to and made only under OrganiserÕs terms and
conditions on their account. SandPiper is not liable for any of these claims.
8. Complaints
Any complaints
regarding the Event shall be directed solely to and dealt with by the
Organiser. Any complaints regarding the Venue shall be directed solely to and
dealt with by the Venue Owner.
9. Liability
Any claims,
complaints and requests relating to the event, should be directed to and
handled by the Organiser.
SandPiper will not be
responsible for loss, damage, death or injury to any person or their property
howsoever caused.
The Organiser
undertakes sole liability for the event and Venue Owner undertakes sole
liability for the venue.
SandPiper does not
warrant or guarantee the quality, suitability, compliance with description or
punctuality of any of the event or venue.
SandPiper has no
control over the maintenance or management of the Venue, or the organisation or
management of the Event.
10. Governing
Law and Jurisdiction
Sale and distribution
of SandPiper tickets shall be governed by the laws of Singapore and Ticket
Holders agree to submit to the exclusive jurisdiction of the Singapore courts.
